Law is not justice and a trial is not a scientific inquiry into truth. A trial is the resolution of a dispute.
~ Edison Haines
This is part of the reason that "alternate dispute resolution" developed as an option for people not wanting to spend the time or the money involved in going to court. So many people assume that going to court is about getting a judge to say that you were right. It doesn't often work out that way. It's also an expensive way to prove a point, with no guarantee that you will.
The point to note is that if all of the parties to a dispute actually want a solution, the court is not necessary. Resolutions can be agreed and amended by agreement if needs be.
Once you go to court though, you are stuck with result.
